The Maryland Aviation Administration (MAA) advertises and awards contracts for commodities, small procurement, service, maintenance, construction, architectural and engineering, and lease and concession contracts. Revenue-producing contracts at a transportation facility are exempt from State Procurement Law. See State Finance and Procurement Article, Section 11-202(3); COMAR 21.01.03.03.B(1)(d). However, the agreement must be approved by the Board of Public Works because the agreement constitutes a lease and use of State property under State Finance and Procurement Article, Section 10-305.
